- In recent Supreme Court case Obergefell v. Hodges, the Court held in a 5–4 decision that the fundamental right to marry is guaranteed to same-sex couples by both the Due Process Clause and the Equal Protection Clause of the Fourteenth Amendment to the United States Constitution. Previously, this issue had been left up to the states. In your opinion, is this a case of basic “civil rights” that deserves protection under the federal government, or is this strictly a state issue? Explain your reasoning.
